This Privacy Policy explains how VisibilityAI, LLC, a Delaware limited liability company ("VisibilityAI", "we", "us", or "our"), collects, uses, discloses, and safeguards your information when you visit our websites, create an account, or use our answer-engine visibility and optimization platform (collectively, the "Service"). By using the Service, you agree to the practices described in this Policy.
For the purposes of applicable data-protection laws, VisibilityAI, LLC is the "controller" of the personal information described here. If you do not agree with this Policy, please do not use the Service.
We collect the following categories of information:
Visibility AI's access to and use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. We use the Google account information described above only to authenticate you and create and manage your account. We do not use it for advertising, we do not sell it, and we do not share it with third parties except as described in this Policy.
We use the information we collect to:
Where the EU/UK General Data Protection Regulation applies, we rely on the following legal bases: performance of a contract (to provide the Service you request); our legitimate interests (to secure, analyze, and improve the Service); your consent (for example, for certain cookies or marketing); and compliance with legal obligations.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose information only as follows:
We use cookies and similar technologies that are strictly necessary to operate the Service - for example, to keep you signed in and to secure your session. We may also use limited analytics cookies to understand how the Service is used. You can control non-essential cookies through your browser settings; disabling strictly necessary cookies may prevent parts of the Service from working.
We also record the pages you visit on this website against an anonymous identifier stored in a first-party cookie, so we can understand how people find us. If you later create an account, those earlier visits are associated with it. This information is first-party only: it is never sold, and never shared with advertisers. Visits that do not lead to an account are deleted after 90 days. If your browser sends a Do Not Track signal, we do not record anything at all.
We work with a limited number of trusted service providers who process information on our behalf to operate the Service. Each is bound by contractual confidentiality and data-protection obligations and may use your information only to provide services to us. They fall into these categories:
We describe these providers by category to protect the confidentiality of our systems. If you require the identity of a specific provider for a data-protection assessment, contact us at privacy@visibility.ai.
To measure your visibility, the Service submits your tracked prompts to third-party AI answer engines (for example, ChatGPT, Perplexity, Gemini, Google AI, Microsoft Copilot, and Claude) and processes their responses to produce your metrics. We send only the prompt content needed to run each scan. We also query third-party search-data and business-data providers to gather ranking, backlink, review, and listing information about your brand and its competitors. Your use of these engines and sources through the Service is also subject to their own terms and privacy practices.
We retain your information for as long as your account is active and as needed to provide the Service, then for a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our agreements. You may request deletion of your account and associated data at any time (see Section 9); some information may be retained where we have a legal basis or obligation to do so.
We use industry-standard technical and organizational measures to protect your information, including encryption in transit, encryption of sensitive stored credentials, access controls, and least-privilege data access. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Depending on where you live, you may have rights to access, correct, update, export, or delete your personal information; to object to or restrict certain processing; and to withdraw consent where processing is based on consent. To exercise these rights, email privacy@visibility.ai. We will respond within the time required by applicable law. If you are in the EEA or UK and believe we have not addressed your concern, you may lodge a complaint with your local supervisory authority.
If you are a California resident, the California Consumer Privacy Act (as amended by the CPRA) gives you the right to know what personal information we collect and how we use and disclose it, to request access to or deletion of that information, to correct inaccurate information, and to not be discriminated against for exercising your rights. We do not sell or share your personal information as those terms are defined under California law. To exercise your rights, contact privacy@visibility.ai.
We are based in the United States, and we and our service providers may process your information in the United States and other countries. Where required, we use appropriate safeguards - such as the European Commission's Standard Contractual Clauses - for transfers of personal information out of the EEA, UK, or Switzerland.
The Service is intended for business use and is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us and we will delete it.
The Service may link to third-party websites and services we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy policies.
We may update this Privacy Policy from time to time. When we make material changes, we will post the updated Policy here with a new "Last updated" date and, where appropriate, notify you.
